Chinese man who crossed illegally arrested for possession of child pornography

A Chinese man detained by Border Patrol on Monday was arrested after authorities found videos depicting sexual acts between a minor and an adult on his phone, according to a criminal complaint.

Tong Sun, who was born in 1977, was charged with possessing videos that contained child pornography.

Sun, while detained at the Central Processing Center in McAllen, was asked for consent to search his cellphone to which he agreed by signing a Border Patrol Consent to Search Electronic Devices form, according to the complaint.

“A (Border Patrol) Evidence Collection Team analyst located videos that contained child pornography on Sun’s primary cellular telephone,” the complaint said.

During an interview with a Homeland Security Investigations special agent, Sun said he was aware of the videos on his phone and intended on deleting them in Mexico before crossing into the U.S. illegally, but “didn’t get the opportunity.”

Sun also admitted to knowing the videos in his possession were illegal.

He stated that he purchased the cellphone containing the videos seven or eight years ago and had it in his possession the entire time and “no one else has had access to it.”

HSI special agents viewed two videos depicting sexual acts between a minor and adult, the first of which depicting an adult man and a minor female, believed to be younger than five years of age.

The second depicts another adult man and a minor female believed to be younger than 13 years of age.

The first video was approximately three minutes and five seconds long while the second video was around one minute and 19 seconds long.

On Tuesday morning, Sun made his initial appearance before U.S Magistrate Judge Juan F. Alanis who set Sun’s preliminary examination and detention hearing for Thursday afternoon.
