A grand jury indicted a 22-year-old Rio Grande City man this week who is accused of t-boning an SUV on Aug. 25, causing a severe crash which killed a toddler and a 52-year-old woman.
David Garcia Jr. is charged in the indictment issued Oct. 22 with two counts of intoxication manslaughter and seven counts of intoxication assault.
McAllen police arrested the man after the accident happened in the 800 block of North 10th Street at approximately 2:44 a.m.
Patricias Vargas, 2, and Alma Patricia Rodriguez, 52, died in the crash, which sent seven others to hospitals with serious injuries.
Garcia remains jailed on a total of $345,000 in bonds.
A Texas Department of Transportation crash report states Garcia was driving on North 10th Street in a black 2008 Chevrolet Silverado when he crashed into a gold 2007 Dodge Durango driven by 30-year-old Luis Andres Cordova.
That report also indicates the toddler killed in the accident was not restrained by a child safety or booster seat and was ejected from the vehicle.
Of the nine people in the vehicle that night, six were not restrained, including Rodriguez, who died; a 1-year-old; 3-year-old; 17-year-old; and a 19-year-old, according to the crash report.
