A man Mission police accused of fatally running down a McAllen man last week wants a judge to reduce the $250,000 bond that is keeping him in jail.
Defense attorney Eric Jarvis filed a motion asking 332nd state District Judge Mario E. Ramirez to reduce Mauro Esparza III’s bond.
The request is scheduled to be heard Monday morning.
Mauro is accused of hitting 22-year-old Jesus Zamudio on the 900 block of West Interstate 2 in Mission July 27.
A Mission police officer found Zamudio’s body “in the grass” near the shoulder of that roadway. He had been working on his car when he was hit and killed.
Mauro and his cousin, Ruby Esparza, turned themselves in to Mission police nearly two days later to tell authorities they were involved in a crash that damaged their vehicle.
According to a probable cause affidavit, Mauro told investigators that he and Ruby had been drinking in downtown McAllen on the night of the accident.
Mauro told police in a recorded statement that he and his cousin were traveling westbound on IH-2 when he crashed with a KIA Sportage.
“(Mauro Esparza) stated he knew he hit a car but was unaware he hit a pedestrian,” the complaint read.
The Mustang Mauro drove showed damage to the windshield and front-right fender area, which contained blood, strands of hair and other human tissue, Mission police said in their report.
After the crash, Mauro fled to Mexico, according to police.
Ruby told police she was sleeping inside the vehicle, but woke up when it collided, the report read.
“She then asked what happened. Mauro replied by saying he had just hit a vehicle,” the complaint read.
Mauro is charged with accident involving death and remains in jail.
Ruby is charged with failure to report a felony resulting in serious bodily injury or death. She was released on a $5,000 bond.
