Despite objections by former Brownsville fire chief Carlos Elizondo’s defense attorney, 107th state District Judge Benjamin Euresti Jr. granted a Cameron County District Attorney’s Office request to reschedule a trial to a later date.
Elizondo, who was scheduled for a jury trial on Monday morning on allegations of 11 counts of computer security breach, is now scheduled for trial on April 22. He has pleaded not guilty to charges.
“I told the court I was ready to start today. I’ll be ready to start April 22,” defense attorney Eddie Lucio said after the hearing.
Assistant District Attorney Art Teniente filed a motion seeking to postpone the jury trial to await the findings of a special master Euresti appointed last year to review items seized by the DA’s Office during a search of his home.
At the hearing, Euresti said he spoke to Lucio and Teniente in chambers and said that the special master, 197th state District Judge Aldofo Cordova, said his report on whether any evidence seized during that search included information protected by attorney-client privilege, would be ready in two weeks.
Both Teniente and Lucio will then be able to review the report and the evidence, Euresti said.
Elizondo faces a separate indictment accusing him of theft and misapplication of fiduciary duty over allegations he stole from the firefighters association. He has also pleaded not guilty to those charges.
