The 16-month-old baby who was allegedly strangled by his 18-year-old dad displayed “pinpoint, round blood spots on the skin around his face consistent with petechiae,” which is commonly found in victims of strangulation, according to a probable cause affidavit.

Edcouch resident Dalyn Josiah Ramos made a first appearance in the Edinburg Municipal Court Wednesday afternoon where he was charged with capital murder of a person under 10 years of age.

According to the affidavit, Edinburg police officer Roberto Garcia responded to 517 E. Samano Street in Edinburg with fellow officers in reference to an unresponsive one-year-old child around 9:44 p.m. on Monday.

Garcia observed EMS arrive and attempt to revive the child who was eventually transported to Edinburg Regional Children’s Hospital where he was pronounced dead.

It was then that the criminal investigations division was requested.

A detective arrived at the scene and was briefed by officer Daniel Torres.

Torres told the detective that Ramos stated “he left his child alone in bed while he showered and that when he got out he discovered his child unresponsive in the bedroom and immediately sought help from family members.”

Back at the hospital, investigator Omar Longoria responded to the room where the dead child was and “observed the child’s body to display pinpoint, round blood spots on the skin around his face consistent with petechiae.”

The affidavit states that Ramos is deaf and communicates primarily through American Sign Language.

Investigators were assisted by certified interpreter Jennifer Marie Garcia in order to communicate with Ramos.

A detective stated that Ramos came to the Edinburg Police Department voluntarily where he implicated himself in the death of his son through the means of “hard choking,” or asphyxiation/strangulation.

Ramos remains jailed at the Hidalgo County Adult Detention Center on a $1 million bond.
