Police have identified the man who fell into a sediment pool while operating an excavator and died Saturday.

The Hidalgo County Sheriff’s Office said 42-year-old Evilorio Garcia was the man who was driving the excavator that submerged into the pond.

According to a news release, deputies were dispatched to 43530 West Expressway 83 at Terra Firma Material Havana in Sullivan City in reference to assist an agency.

The call was later reclassified to an equivocal death.

Upon arrival, deputies found a submerged CAT Excavator in a sediment pool and learned that a male employee, later identified as Garcia, was inside.

The release states that he was supposed to be removing sediment from a pond on the north side of the property.

Mission firefighters arrived with other surrounding agencies and managed to cut open the top of the excavator’s roof in order to extract Garcia’s body from inside the cab.

Justice of the Peace J.J. Pena later arrived at the scene and pronounced the time of death at 4:29 p.m. and ordered an autopsy.

The case remains under investigation.
