The city of Edinburg and council member Homer Jasso Jr. are scheduled to face off in court again Friday morning, but the battle will have to continue without Jasso, who remains hospitalized after being rushed to the emergency room Thursday morning.
Earlier this month, state District Judge Mario E. Ramirez Jr. gave both parties time to respond to each others’ claims after Jasso filed a third amended petition. That time has now run out.
A hearing is scheduled for 10:30 a.m. in Ramirez’s courtroom where he will consider whether the council can oust Jasso for allegedly violating the city charter. Jasso is accused of profiting from city coffers despite an ordinance prohibiting him from doing so.
Four of his fellow councilmen determined he had willfully violated the charter after an inquiry in March, but Jasso obtained a temporary injunction that stopped them from removing him from office.
Since then, the issue has been handled by the court.
Jasso is not expected to attend Friday’s hearing. He was transferred to Doctors Hospital at Renaissance in Edinburg Thursday morning after feeling ill, his family posted on social media.
He remained hospitalized as of Thursday afternoon, and was told by his physicians he would remain there until at least Friday afternoon, he said, but did not disclose his medical condition.
