Former Brownsville fire chief Carlos Elizondo appeared Wednesday in the 107th state District Court, where he entered a not guilty plea to charges of theft by a public servant and misapplication of fiduciary property.
Elizondo, represented by attorney Eddie Lucio, waived the reading of the indictment filed against him. His trial date has been schedule for Jan. 16.
Lucio said Elizondo has a very good chance of winning the case because the evidence against him is not strong enough.
“What we’re going to do is look at the evidence, we’re going to defend against it and, at this point, the evidence looks weak to us,” Lucio said outside the courtroom.
A CameronCounty grand jury last month indicted Elizondo on a charge of theft by a public servant and misapplication of fiduciary property.
The grand jury handed down the indictment one day after he was arrested on the charges.
