La Villa man kicked cat to death, said he had a gun when police went to arrest him

Police in La Villa have arrested a man who kicked his girlfriend’s cat to death earlier this month.

And as they were on their way to arrest 33-year-old La Villa resident Jose Alfredo Rostro last Thursday after he kicked his girlfriend out, he called Hidalgo County dispatch to claim he had a gun.

While Rostro did not have a gun, police said in a probable cause affidavit that he had an 8-inch knife that had a 5-inch handle when they arrested him following a struggle.

La Villa police arrested Rostro after responding at about 2:33 p.m. to a church located on the corner of 2nd and Martel Street, according to the affidavit.

This is after his girlfriend called police to report that he had just kicked her out.

“At this time dispatch relayed that her boyfriend had just called the county and told them that he had a gun,” the affidavit stated.

Minutes later, the girlfriend called police to say Rostro was walking toward her.

“He was walking very fast with his hands behind his back as Chief F. Ramos also wearing a full police uniform driving a fully marked police unit arrived on scene,” the affidavit stated.

La Villa police officers drew their weapons and ordered Rostro to the ground. They say he refused to follow commands, struggled and tried to run before being taken into custody.

The warrant for his arrest involved the death of the cat.

A probable cause affidavit said that incident happened at about 1:50 p.m. on July 9.

That affidavit said that Rostro admitted to kicking the cat more than one time, resulting in its death.

Rostro is charged with cruelty to non-livestock animals and resisting arrest.

He remains jailed in the Hidalgo County Adult Detention Center on a total of $130,000 in bonds.
