Motion filed to dismiss Starr County abortion murder indictment

A motion was filed Monday morning to dismiss the murder indictment against a Starr County woman who had a “self-induced abortion,” according to the district clerk’s office.

The motion was filed at 9:30 a.m., the staff said.

The motion comes a day after Starr County District Attorney Gocha A. Ramirez announced that his office would drop the indictment against Lizelle Herrera, who was arrested Thursday and charged with murder.

“In reviewing applicable Texas law, it is clear that Ms. Herrera cannot and should not be prosecuted for the allegation against her,” the release read.

Her arrest caused outrage throughout the Rio Grande Valley and generated interest across the country.
